Blossom Creator Program Terms & Conditions

These Blossom Creator Program Terms & Conditions ("Terms") govern your participation in the Blossom Creator Program operated by Blossom Social Inc. ("Blossom").
By checking the acceptance box and submitting your application, you acknowledge that you have reviewed and agree to these Terms. If your application is approved, these Terms will govern your participation in the Creator Program.
1. Creator Responsibilities
As a member of the Blossom Creator Program, you agree to:
- Create and share content promoting Blossom and the Blossom Social App on your social media channels or other approved platforms.
- Engage authentically with your audience regarding Blossom where appropriate.
- Create a Blossom account and connect your brokerage, where applicable.
- Submit eligible content through the designated Blossom Creator Discord so it can be tracked and credited toward your Creator Program progress, rewards, and payouts.
- Follow any current challenge requirements, submission instructions, or Creator Program guidelines communicated by Blossom.
2. Your Unique Tracking Link
Blossom will provide you with a unique tracking link for promoting the Blossom Social App.
A user who downloads and signs up for Blossom for the first time through your unique tracking link will be considered a "New User", provided the referral meets the validity requirements outlined below.
You are responsible for using your unique tracking link correctly when participating in referral-based challenges or promotions.
3. Content Standards
Content submitted or created as part of the Creator Program must meet the following standards.
Sponsorship Disclosure
Your relationship with Blossom must be reasonably clear to your audience.
Disclosure may be made verbally within your content, in the caption, through your profile/bio, or through an appropriate disclosure such as #BlossomCreator.
Creators are also responsible for following any advertising or disclosure requirements applicable to the platform on which the content is posted.
Accurate Representation
You may not materially misrepresent:
- The features or functionality of the Blossom Social App;
- Blossom's regulatory status; or
- How Blossom handles user funds or data.
Platform Rules
You must follow the terms and policies of the platforms on which you publish content.
The use of bots, purchased followers, purchased engagement, engagement pods, or other methods intended to artificially inflate performance is prohibited.
Lawful & Appropriate Content
Content created through the program may not be discriminatory, harassing, defamatory, sexually explicit, or promote illegal activity.
Blossom may refuse to credit, require the removal or amendment of, or withhold payment for content that does not comply with these standards or applicable Creator Program requirements.
4. Compensation & Rewards
Creators may earn compensation through activities including:
- New User referrals;
- Creator challenges;
- Streaks;
- Action bonuses;
- Performance-based or view-based bonuses;
- Whitelisting; and
- Other promotions, contests, rewards, or opportunities made available through the Creator Program.
The compensation, reward amounts, eligibility requirements, and challenge rules that apply will be those most currently posted within the Blossom Creator Program at the time of participation or posting.
Blossom may change, introduce, suspend, or discontinue Creator Program rewards, compensation structures, bonuses, challenges, or prizes at any time.
Participation in the Creator Program does not guarantee any minimum level of compensation.
5. Payment Terms
Creator compensation is inclusive of applicable taxes.
You are responsible for determining and paying any income tax, sales tax, VAT, or other governmental charges that may apply to payments you receive through the Creator Program. Blossom will not gross up payments for tax purposes.
Payments are generally issued within 7 days following the end of each month through PayPal, Interac e-Transfer, or another payment method made available by Blossom.
A minimum earned balance of $50 is required before a payout will be issued.
If your balance is below $50 at the end of a payment period, the balance will carry forward until the minimum payout threshold is reached.
You are responsible for providing accurate and up-to-date payment information. Blossom is not responsible for payments sent using incorrect information supplied by you.
6. Valid Referrals
Compensation is only payable for valid New Users.
The following will not qualify as valid referrals:
- Accounts created through emulators, automation, device farms, or masked or falsified device/location information;
- Duplicate accounts or multiple accounts attributable to the same individual;
- Downloads or registrations generated by directly offering payment, rewards, or other consideration solely in exchange for downloading the Blossom app; or
- Accounts deleted or the app uninstalled within 7 days of account creation.
Blossom will determine referral validity using its internal analytics and records.
If a referral is later determined to be invalid, Blossom may withhold the associated payment, deduct the amount from current or future Creator Program earnings, or request repayment of amounts previously issued.
Artificially generated accounts or deliberate manipulation of Creator Program tracking may result in immediate removal from the program and forfeiture of unpaid amounts.
7. Whitelisting & Paid Promotion
Whitelisting allows Blossom to use eligible Creator content as paid advertising.
If you enroll in whitelisting, you grant Blossom a non-exclusive, worldwide licence to use, reproduce, display, distribute, and promote Creator Program content together with your name, social handle, image, likeness, and voice as they appear in that content.
This licence allows Blossom to use the content for:
- Paid advertising on third-party platforms;
- Blossom's social media channels; and
- Blossom's website and other owned marketing channels.
Editing
Blossom may crop, trim, resize, add captions, subtitles, graphics, end cards, or otherwise adapt your content for different advertising formats, provided the edits do not materially change the substance of what you communicated.
Content Selection
Blossom determines which Creator content, if any, it chooses to promote and how much advertising spend is allocated to that content.
Participation in whitelisting does not require Blossom to promote your content or spend any minimum amount.
Whitelisting Compensation
When Blossom runs your eligible Creator content as paid advertising, you will earn 10% of the media spend attributed to that content.
Blossom will provide information regarding applicable media spend as part of the Creator Program payment process.
Opting Out
You may opt out of whitelisting at any time by contacting the Blossom team through the Creator Discord or another designated communication channel.
If you opt out while advertising is already active, existing advertising may continue for up to 60 days. You will continue earning the applicable 10% media-spend compensation during that period.
Opting out applies to future use and does not affect compensation already earned.
8. Program Termination
Either you or Blossom may end your participation in the Creator Program with 7 days' written notice, with or without cause.
Blossom may also immediately suspend or terminate participation in cases including:
- A material breach of these Terms;
- Fraudulent or artificially generated accounts;
- Manipulation of tracking or referral systems;
- Material violations of Creator Program rules; or
- Other conduct that undermines the integrity of the Creator Program.
Termination does not eliminate rights or obligations that arose before termination, including any valid amounts already earned.
9. Confidentiality
During your participation in the Creator Program, you may receive private or non-public information relating to Blossom, including campaign strategies, upcoming promotions, Creator Program initiatives, PR plans, content plans, product information, or other confidential materials.
You agree to use confidential information only for your participation in the Creator Program and not disclose it to third parties without Blossom's prior permission.
10. Limitation of Liability
Neither you nor Blossom will be liable to the other for indirect, special, incidental, or consequential damages arising from participation in the Creator Program or these Terms.
11. Blossom Brand & Materials
Blossom may permit you to use certain Blossom logos, graphics, screenshots, brand assets, or other materials in connection with approved Creator Program content.
Use of Blossom branding must follow any instructions or brand guidelines provided by Blossom and may be subject to Blossom's approval.
Participation in the Creator Program also gives you permission to publicly perform the Creator services contemplated by the program.
12. Independent Contractor Relationship
Your participation in the Creator Program does not create an employment, partnership, agency, or joint-venture relationship between you and Blossom.
You participate as an independent contractor and are responsible for your own activities, expenses, taxes, equipment, and business obligations.
13. Changes to the Creator Program
Blossom may update these Terms or modify the Creator Program, including its challenges, rewards, compensation, participation requirements, or other features.
The most current version of these Terms and current Creator Program opportunities will be made available through the Creator Program, Blossom Discord, application portal, or another designated Blossom channel.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
Any legal proceeding relating to these Terms will be subject to the jurisdiction of the courts of the Province of Ontario.
15. Acceptance
By checking the acceptance box and submitting your Creator Program application, you confirm that:
- You have had the opportunity to review these Terms;
- You understand the requirements of participating in the Blossom Creator Program; and
- You agree that, if accepted into the program, your participation will be governed by these Terms.
